Text Message Terms and Conditions

For client’s and prospective client’s convenience (“you”, “your”), Kaplan Insurance Agency (“us”, “we”, “our”) may send and receive MMS and SMS text messages to communicate with you regarding insurance matters, policy service, inquiries and promotions. The phone number you receive text messages from will be the direct number of one of our advisors or account managers. Consent to text/opting in is not required as a condition of purchase or doing business with Kaplan Insurance Agency.

By agreeing to receive text messages, you are voluntarily opting in to receive text messages at the mobile phone number associated with your opt-in, even if such number is registered on any state or federal “Do Not Call” list. You agree that any mobile phone number you provide to us is a valid mobile phone number of which you are the owner or authorized user. If you change your mobile phone number or are no longer the owner or authorized user of the mobile phone number, you agree to promptly notify your account manager. You may opt out at any time by texting STOP.

Consent Communications

Customer privacy is important to us. All information will be handled in accordance with the privacy policy below. Information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.


Type of SMS Communications

If consent has been given to receive text messages from Kaplan Insurance Agency, messages may be received related to the following:
Appointment reminders
Conversational / Follow-up messages
Billing inquiries
Example: "Hello. Please provide the VIN number for your 2002 Ford Taurus.”

Message Frequency

Message frequency may vary, you may receive up to 5 SMS messages per week related to follow-up communications. 

Potential Fees for SMS Messaging

Standard message and data rates may apply, depending on the carrier's pricing plan. These fees may vary if the message is sent domestically or internationally.

Opt-In Method

You may opt-in to receive SMS messages from Kaplan Insurance Agency by selecting “I agree to receive SMS text messages” on the Electronic Form “Electronic Delivery and SMS Texting Authorization” that is emailed to you in conjunction with your insurance application paperwork.

You can text your Account Manager or Agent at Kaplan Insurance Agency for information regarding our services. By texting Kaplan Insurance Agency, you agree to receive conversational messages.

    Opt-Out Method

    You can opt out of receiving SMS messages at any time by replying "STOP" to any SMS message received. Alternatively, you can contact your account manager directly to request removal from our messaging list

    If you are experiencing any issues, you can reply with the keyword HELP. Or you can get help directly from your account manager or at KaplanInsuranceAgency.com.

    Additonal Options

    If you do not wish to receive SMS messages, DO NOT select the option for the SMS consent box on our forms.

    Hours of Operation

    Communications may occur between the hours of 8am and 8pm in the client’s time zone. We may communicate outside of those hours if the communication was initiated by the client outside of those hours. 

    Disclaimer of Warranty and Liability

    You agree that neither we nor our service providers will be liable for any failed, delayed, or misdirected delivery of any mobile message or information sent.

    Our mobile messaging platform may not recognize requests that modify the foregoing commands, and you agree that we and our service providers will not be liable for failing to honor requests that do not comply with the requirements in these Mobile Messaging Terms. We may also change the telephone number we use to text and we will notify you of any such change. You acknowledge that any requests sent to a telephone number that has been changed may not be received by us and we will not be responsible for failing to honor a request sent to a telephone number that has been changed.

    Modifications

    We may modify or cancel the Program or any of its features at any time, with or without notice. To the extent permitted by applicable law, we may also modify these Mobile Messaging Terms at any time. Any such modification will take effect when it is posted to our website. You agree to review these Mobile Messaging Terms periodically to ensure that you are aware of any modifications. Your continued participation in the Program will constitute your acceptance of those modifications.

    We use the information collected to process applications, issue policies, hande claims, and provide customer service for your insurance.

    We do not disclose any non-public personal information about our policyholders except as permitted by law. In some cases, this information can be disclosed to third parties without your authorization. These disclosures may include those made to your insurance company, appraisers, independent adjusters, insurance regulators, and/or your mortgage lender or lienholder. It is the agency’s normal procedure that your policy could be remarketed for purposes of renewing or replacing it. We do not sell our customer lists. Your information including SMS opt-in and phone numbers collected for SMS communication purposes will not be shared with any third party and affiliates for marketing purposes.

    Data Retention

    We may retain any data collected indefinitely.

    Your Rights

    You have the right to access, update or delete your data at any time.

    Children’s Online Privacy Protection

    We do not obtain any information on children 13 years or younger.

    Security - How We Protect Your Personal Information

    We restrict access to your personal information to those employees who need it to provide the insurance products and services you have requested or general servicing of your account and policies. We maintain physical, electronic and procedural safeguards to protect your personal information.
